MyTradingVault Privacy Policy

This Privacy Policy describes how we, MyTradingVault, LLC (“MTV,” or “we,” or “us”) may collect information about you when you access our website located at MyTradingVault — Your Options Trading Command Center (the “Site”) and the platform accessible through the Site (the “Platform”), and how we may use, store, share, or otherwise process that information. Please do not use the Site or the trading journal service offered through the Platform (the “Service”) if you object to any of our policies or practices described here or in our Terms Of Use. We may update this Policy at any time. Any changes to the Policy will become effective upon the date of our posting of the revised Policy on the Site. If any of the changes will materially affect your rights, we will post a notice on the Site stating that the Policy has been revised. If you use the Site following the effective date of the revised Policy, you will be deemed to have accepted the Policy’s updated terms.

1. What Information Do We Collect About Site Users?

You may explore the Site without providing any personal information (information that identifies you, could be used to identify you, or is specifically linkable to you). But we invite you to use our Service by registering on the Site, which will give you access to the Platform. In order to register, you need only provide your first and last name, your email address, and a username and password that you create.

As stated in our Terms of Use, our Service is not directed to minors, and we do not permit minors to use the Service without the consent of their parent or guardian. We do not knowingly collect personal information from any individuals under age 13.

2. How Do We Use the Information We Collect?

We may use the personal information that we collect about you for any or all of the following purposes:

(a) Responding to Requests. To respond to your requests, such as to answer your questions about the Site, the Platform, or the Service, and to assist you in using the Service.

(b) Providing Information. To provide you with information regarding the Service that may be of interest to you, for example in emails to you about new functionalities in the Platform.

(c) Our Own Business Purposes. For our own business purposes, such as to help us improve the Service by requesting feedback from you, and for related internal purposes such as data analyses and internal audits.

3. With Whom Do We Share the Information We Collect?

(a) Service Providers. We share personal information about the users of our Service with unaffiliated third parties who provide us with support services, such as the designer of the Platform and others who assist us with technology, data analysis, or similar services. We do not share personal information with unaffiliated third parties for their own marketing purposes.

(b) Acquirers or Assignees. In the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or a portion of MTV or its assets, we may transfer the personal information that we have collected from users of our Services to the acquiring party or assignee.

(c) Entities Entitled Under Law. We may disclose personal information as we believe to be appropriate in the following circumstances: (i) when required by applicable law, including laws outside your country of residence; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce the terms and conditions for use of the Services, including this Policy; (v) to protect and defend our rights and property; (vi) to protect the interests of MTV or others; and (vii) to permit us to pursue available remedies or limit the damages that we may sustain. We have no obligation to notify you of such disclosures, except as required by applicable law.

4. How Do We Maintain and Protect Personal Information?

(a) Security. We use reasonable organizational, technical and administrative measures to help protect against the loss, misuse and alteration of the information under our control. However, no data transmission over the Internet or data storage system is reliably 100 percent secure. We cannot guarantee complete security of the information you provide to us.

(b) Data Retention. We will retain personal information about you for the period necessary to fulfill the purposes outlined in this Policy.

5. Rights You May Have Regarding Your Personal Information

Depending on the laws of the jurisdiction in which you reside, you may have one or more of the following rights with respect to some or all of your personal information:

  • To request a description of personal information we have collected about you, how we have used that information, and with whom we have shared it during the past 12 months;
  • To request a copy of the personal information we have collected about you;
  • To request that we correct your personal information;
  • To request that we delete your personal information;
  • To request that we limit the use or sharing of certain of your personal information.

We may not be obligated to grant your requests, but we will not discriminate against you for exercising any of the rights to which you are entitled.

If you wish to exercise any of these rights with respect to your personal information, please submit a request to us by emailing us at: support@mytradingvault.com. You may make a request on your own behalf or may designate an authorized agent to make a request on your behalf, in which case, you must provide us with a signed declaration stating that you permit that individual to act on your behalf and stating such individual’s full name, address, email address, and phone number. We may, after receiving your request, require additional information from you to verify your or your designated agent’s identity in order to protect your personal information from unauthorized disclosure or deletion at the request of someone other than you or your legal representative. We cannot grant your request if we cannot verify your identity or authority to make the request.

Please be aware, as noted, that we are not obligated to grant all requests that you may make, depending on applicable law. For example, we may deny a request for deletion of personal information if we have a legal basis for retaining that information. If your request is denied, you may appeal that decision by contacting our privacy support team at support@mytradingvault.com. Within 45 days of receiving your appeal request, we will inform you in writing of any action taken or not taken in response, along with a written explanation of the reasons in support of the response. Depending on the state in which you reside, you may have the right to contact your state attorney general if you have concerns about the result of the appeal or would like to submit a complaint. If this right is available to you, we will provide you with instructions on how to do so.

We endeavor to respond to a verifiable request within forty-five (45) days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing.

6. Collection of Your Personal Information by Others

(a) Tracking on Our Site. We do not currently allow others to collect the personal information of visitors to our Site.

(b) Other Websites. The Site may contain links to websites operated by parties not affiliated with MTV. These linked websites are not under our control, and we are not responsible for the privacy practices or the contents of any such unaffiliated parties or their websites. If you provide personal information through any such third-party website, the personal information will be collected by that third party and controlled by its privacy policy, not this one. We recommend that you familiarize yourself with the privacy policies and practices of any such third parties.

7. International Transfers of Information

By using the Services, you are deemed to understand and unambiguously consent to the collection and processing of your personal information in the United States, with the awareness that the laws of the United States may not provide as much protection for personal information as the laws of certain other countries or territories.
